财务人必须知道的12个税务小诀窍

1、技术入股少缴税

很多民营企业的老板都是技术专家,拥有相应专利,但将专利提供给公司使用时并没有说明该技术属于何种方式使用。

建议老板们将技术专利作价投入注册公司,一方面可以改善公司的财务状况,减少投资时的资金压力;一方面,作价入股以后,公司可以将其计入无形资产,做合理摊消——增加成本费用,减少利润,少缴所得税。

2、电子商务减印花

目前我国对电子商务同样征收增值税,但根据税务总局的规定,在供需经济活动中使用电话、计算机联网订货,没有开具书面凭证的,暂不贴花。因此,企业完全可以放弃传统的经商模式,让所有订货过程都在网上完成,即可节省印花税。

3、存款少可迟缴税

企业申报后就应及时缴税,但存款少则可以申请延迟缴税。存款少到什么程度可以延迟?可动用的银行存款不足以支付当期工资,或者支付工资后不足以支付应交税金。

注意:可动用的银行存款不包括企业不能支付的公积金存款,指定用途的存款,各项专用存款。

4、申办时间很重要

张三的新公司,税务登记在6月30日,李四的新公司,税务登记在7月1日。两个公司都向税务机关递交了要求享受新办企业的税收优惠政策。年底时税务机关 批复:张三的公司当年已享受了一年的所得税优惠,明年开始缴纳所得税;李四的公司可以选择今年的利润先缴纳,明年再开始计算享受一年的所得税优惠。根据税 务规定:上半年开业的公司当年算一年免税,下半年开业的公司可以选择。一日之差,命运各异。

5、重设流程纳税少

对于很多生产型公司,设立自己的销售公司就可以避免过高的消费税负担。公司的产品先销售给销售公司,销售公司再卖给经销商或者客户。由于消费税在生产环节纳税,销售环节不纳税,因此,销售公司不纳消费税,只要定价合理,就可以少交部分消费税。

6、先分后卖纳税少

某公司投资一家企业,占有其60%的股权,该企业市场运作良好,公司连年盈利,这60%的股权价值涨了不少。现在公司老板想转让股权,财务经理提议应先把利润分了再转让,这样可以少缴税。因为先分配不用补税,不分配就要缴税。

7、做善事也有讲究

做善事也与纳税有关。企业对外捐赠的款项和实物,一是可能涉及视同销售,缴纳增值税,因此,在捐赠时,要考虑税务负担;二是捐赠要合理进入成本费用,还 有符合税务上的条件,包括需要通过税务机关认可的单位和渠道捐赠以及有符合税法规定接受捐赠的专用收据。如果不符合条件,捐赠后不能进入成本费用,结 果还要纳25%的所得税。

8、这些也是生产型企业

外资生产企业“两免三减半”的规定,但只有生产型企业才能享受,服务企业不能享受。到底什么是生产型企业?

根据《外资企业所得税法》,建筑、货物运输、产业资讯、精密仪器设备维修、城市污水处理等行业都属于生产性企业。

9、多拿进项多抵扣

作为一般纳税人,销项减去进项的部分需要缴纳税款,因此,多拿进项就可以少缴税。这些进项包括:购买办公用品、购买低值易耗品、汽车加油、购买修理备件……日积月累,企业就能降低税负。

10、赠得巧来送的妙

顾客购买一件2000元的电器,商场赠送一件400元的小家电,合计2400元,实际只收2000元。如果当作赠送,要按2400元缴纳增值税。如将两 件产品卖给顾客,给予顾客400元的折扣,对顾客而言,同样是支付2000元;对商场而言,由于是价格折扣,只要按2000元实际营业额缴纳增值税即可。

11、出租不能免税

内资企业租赁房屋需按租金缴纳12%的房产税,外企则为18%。广东规定:外企新购置的房产可以享受免征房产税三年的优惠政策。

某外企购买了一层办公楼,一半自用,一半出租,在申请免税时被税务机关退了回来:房屋出租部分不能免房产税。企业只好缴纳了18%的房产税。真是冤枉到家。广东规定的免税条件是不分自用还是出租。企业多缴了税还被蒙在鼓里。

12、没有生意也要申报

企业可能因为各种原因没有税款要缴纳,但都要按时纳税申报。没有应纳税税款的申报就是所谓的零申报,只需走一个简单的程序。但如果不办理,税务机关可每次处以2000元的罚款。
