工商局对办公场地所资料的具体要求

一、 客户有房产证:

1、如果是私人房产的房产证,提供房产证复印件(市工商局要提供《共有权人证》及《所有权人证》)(经开区工商局还需提供房东的身份证复印件)。

2、如果是企业或单位房产的房产证,提供房产证复印件(加盖公章),房东的名称与租赁合同出租方要一致,(一个字也不能差),如果房东的名称与租赁合同出租方不一致,有以下几种情况:

A、企业或单位名称已变更,要提供上级机构核发的变更文件或企业或单位出具证明,说明原名称及现名称,如有产权纠纷由本企业或单位负责。

B、企业或单位已出租给某某公司,提供房产证复印件;企业或单位和某某公司的租凭合同复印件;(合同内不能有“不能转租给第三方的字样”); 企业或单位出具证明,说明房产的权属及已出租给某某公司并同意某某公司转租给客户使用;某某公司和客户的租凭合同原件。

C、企业或单位委托某某公司或下属机构代理出租的,提供房产证复印件;企业或单位出具证明,说明房产的权属及已委托某某公司或下属机构代理出租并同意某某公司或下属机构转租给客户使用,如有产权纠纷由本企业或单位负责;某某公司或下属机构和客户的租凭合同原件。

二、租赁合同的标准:

1、承租方:客户已核准的企业名称(筹)十法人签字;

2、承租方:法人或股东或别人的,提供全体股东签字的委托某某代租证明。(市工商局一般不能通过)。

3、租赁合同如果以已核准的企业名称签订的,租凭期限要在已领取《企业名称预先核准通知书》以后,租凭期限要在一年以上。

三、那些场地需出具居委会证明:

房产证或购房合同上的房产用途为:住宅或商住或私用等(不是办公用的)都需出具居委会证明。办理居委会证明一般需交纳租金税,1000元的租金按12%收取税金。

四、客户有购房合同:

提供〈购房合同〉(1-15页)及《商品房现房销售备案证明》(复印A4纸并加盖开发商公章);未取得〈商品房现房销售备案证明〉的提交〈商品房预售证〉(复印A4纸并加盖开发商公章)及开发商证明,A4纸并加盖开发商公章),《竣工验收备案表/意见书》(A4纸并加盖开发商公章)。

 

五、 租赁单位或村委房产没有房产证:

提交单位或村委证明及土地证复印件或土地规划证复印件(加盖公章)和租赁合同原件(参考:一、2点),《竣工验收备案表/意见书》(A4纸并加盖开发商公章)。;

六、军队房产:

提交军队证明及土地证复印件或土地规划证复印件(加盖公章)和租赁合同原件(参考:一、2点),另需提供 [军队房地产租赁许可证];

七、 出租方为宾馆、饭店的,提交宾馆、饭店营业执照复印件(加盖公章)及租赁合同原件(参考:一、2点);。

八、证明一般含有那些内容?

1、办公地址具体地址;

2、该场地产权属于谁所有;

3、现出租给某某公司使用;

4、租赁期限(不能低于一年);

5、产权纠纷由谁承担责任。
