医疗器械行业迎来立法监管时代,意味着什么?

上海市食品药品安全研究会首席研究员唐民皓介绍,为了保证医疗器械的安全有效,保障人体健康和生命安全,促进医疗器械产业发展,2020年12月,国务院第119次常务会议修订通过《医疗器械监督管理条例》。

“尽管该条例为我国医疗器械的法治建设提供了坚实基础,但在应对日益复杂的产业形势和全球治理趋势时,我国医疗器械行业发展迫切需要更加系统完善的法律制度设计。”唐民皓介绍说,从整体来看,该法的制定背景与国际医疗器械监管的发展趋势密切相关。在全球医疗器械市场中,技术创新和安全监管是两大关键因素。为了在国际竞争中占据一席之地,我国必须在法律上进行系统性创新,在确保医疗器械产品质量安全的同时,从法律制度层面促进产业的快速进步。

在技术创新方面,沈阳药科大学现代产业学院管理办公室副主任(主持工作)、医疗器械学院医疗产品管理专业教授项荣武表示,随着我国医疗器械行业的快速发展,我国有必要通过制定专门法律,在科技创新、财政支持、行业规范、产学研衔接、全生命周期管理等方面作出全面系统的规定,以促进医疗器械行业高质量科学发展。此外,制定专门法律有助于对接国际医疗器械管理法律制度,发挥我国在相关国际组织中的影响力。

在安全监管方面,南开大学法学院院长、南开大学医药卫生法研究中心主任宋华琳认为,在转型时期,法律制度难免滞后于社会的发展。现行的《医疗器械监督管理条例》作为行政法规,给予行政部门在实体和程序方面过大的裁量权,在监管方式、监管程序等方面规定不够细致,其法律责任的设定较为粗放,严谨性不足,其作用已经不符合当下医疗器械行业的发展实际,未能完全按照高风险健康产品监管的全过程,或者按照风险监管的逻辑去设计相应监管结构和框架。
